How To Check if You're Eligible

To qualify for a SDLT refund, your property must meet the following criteria:

  • The property must be a buy-to-let or second home
  • The property must have been purchased within the last four years.
  • The property must have had qualifying defects at the time of purchase.

SDLT refunds can provide significant financial relief for homeowners who have invested in properties that turned out to have issues that negatively impacted their quality of life. If you believe that your property meets the above criteria, it is worth exploring your options for reclaiming SDLT.

We will need some basic information along with some supporting legal evidence to support your claim. We will either obtain this list from yourself on request or from your solicitor on your behalf.

You can claim back for any purchase of up to 4 years since the date of purchase.

We operate on a ‘No Win No Fee’ basis. In the case of a successful claim, our service charge is 25% + VAT of the total rebate and interest received. Our minimum fee is £1,000 + VAT. Note. HMRC has an allowance to revisit claims within 9 months of pay-outs.

The process will usually take 6-8 weeks from we submit the claim to the HMRC until you get a refund.

Evidence can be varied, with photographs, videos, receipts for building work, property survey, quotes, and even improvement notices all coming in handy.

The invoice and picture must clearly support your claim that the property was uninhabitable at the time of purchase.

In our assessment of whether property was capable for use as a dwelling, and suitable for ‘immediate’ habitation, we took into consideration the following factors:


  • Facilities for personal hygeine
  • The ability to consume food and drink
  • The storage of personal belongings and a place for an individual to rest and sleep.


The property, may, therefore, be deemed uninhabitable if there is a non-functioning bathroom or kitchen area, presence of mould or abestos, an unsafe electrical system, no clean running water, unsafe chemicals present, structural damage (either external or internal), nothing in place to keep the property weather-proof (e.g. an appropriate roof), or animal, plant or insect infestations.
